Terms

Occaselle Terms of Use

Effective Date: October 27, 2026

These Terms of Service (“Terms”) govern your access to and use of the wedding website creation, hosting, guest management, RSVP, and related services provided by Destine LLC (“Destine LLC,” “we,” “us,” or “our”) through Occaselle and any associated website or service at occaselle.com (collectively, the “Service”).

By purchasing, accessing, or using the Service, you agree to these Terms.

1. The Service

The Service allows customers to create, customize, publish, and manage a wedding website using available templates, themes, sections, and features.

Depending on the features available to your account, the Service may include:

  • wedding website customization and publishing;

  • wedding details, schedules, travel information, registries, dress-code information, photo galleries, and other wedding content;

  • guest and household management;

  • invitation links or invite tokens;

  • RSVP collection;

  • custom RSVP questions;

  • privacy and visibility controls; and

  • website hosting for the included hosting period.

Features may change, be improved, or be discontinued over time.

2. Eligibility and Account Responsibility

You must be at least 18 years old and legally able to enter into a binding agreement to use the Service.

You are responsible for:

  • maintaining the confidentiality of your account credentials;

  • all activity performed through your account;

  • keeping your account and wedding information accurate;

  • ensuring that individuals you authorize to access or edit your wedding site are permitted to do so; and

  • notifying us promptly if you believe your account has been accessed without authorization.

3. Purchases and Access

Purchases may be made directly through Occaselle, through Etsy, or through another authorized sales channel.

Access to the Service may require manual or automated activation following purchase.

You agree to provide accurate purchase and wedding information when required for account activation.

We may request information reasonably necessary to verify a purchase before providing or restoring access.

4. Refund Policy

Because the Service provides access to a digital product and customizable hosted service, purchases are generally non-refundable once access has been provided, redeemed, or site creation has begun.

For direct purchases, access and website setup may become available shortly after payment is completed.

Refunds may be considered in limited circumstances, including duplicate charges or a technical issue on our end that prevents us from providing the purchased Service.

To request a refund, contact support@occaselle.com with your order details. Please do not include payment card details or your account password.

This policy does not limit any refund, cancellation, or consumer rights that may apply under applicable law or the policies of the marketplace through which you purchased the Service, including Etsy. Purchases processed through Stripe Managed Payments are also subject to the applicable Managed Payments and Link refund procedures. Stripe may process refunds under those procedures independently of a request made directly to Occaselle.

Once a full refund is successfully processed and recorded, the website associated with that purchase is unpublished and editing access ends. A partial refund does not, by itself, end website access or change the original hosting period.

A refund does not itself delete your account or saved website content. Continued retention is subject to our Privacy Policy and any applicable deletion request; a refund does not guarantee indefinite storage or continued hosting of that content.

5. Included Hosting Period

Your purchase includes twenty-four (24) months of live website hosting beginning on the purchase date. The hosting period does not depend on your wedding date or on when you first publish your website.

The applicable hosting period may be recorded using account or membership information such as the purchase date, hosting start date, and hosting end date.

During the included hosting period, you may publish and maintain your wedding website subject to these Terms.

Changes to the Wedding Date

Changing the wedding date displayed on your wedding website does not extend, restart, or otherwise modify the included hosting period.

The hosting period associated with your purchase is based on the applicable purchase and hosting records maintained by us, not solely on the wedding date shown on your website.

After the Included Hosting Period

When the included hosting period ends, the live wedding website may be unpublished or otherwise made unavailable unless an additional hosting extension is purchased or otherwise provided by us.

Expiration of live website hosting does not necessarily mean that your account or associated data will be immediately deleted. Data retention and deletion are handled in accordance with our Privacy Policy.

Additional hosting periods or extensions may be offered separately in the future at the pricing and terms available at that time.

6. Customer Content

You retain ownership of the content you submit to the Service, including photographs, written content, wedding information, registry information, schedules, guest information, and other materials (“Customer Content”).

By uploading or submitting Customer Content, you grant Destine LLC a limited, non-exclusive license to host, store, reproduce, display, process, and transmit that content solely as reasonably necessary to operate, maintain, support, and provide the Service.

You represent that you have the rights or permissions necessary to upload and use all Customer Content you submit.

You may not upload content that:

  • infringes copyrights, trademarks, privacy rights, publicity rights, or other legal rights;

  • is unlawful, fraudulent, defamatory, threatening, or abusive;

  • contains malicious software or code;

  • is intended to interfere with or damage the Service; or

  • otherwise violates applicable law.

7. Guest Information and RSVP Data

The Service may allow you to enter or collect information about wedding guests.

This may include:

  • guest names;

  • household information;

  • email addresses or phone numbers;

  • invitation status;

  • RSVP responses;

  • attendance information;

  • dietary restrictions;

  • event-specific responses; and

  • answers to custom questions created by you.

You are responsible for ensuring that your collection and use of guest information is lawful and appropriate.

You should only request guest information that is reasonably necessary for managing your wedding and related events.

You may not use guest information obtained through the Service for unrelated advertising, spam, unlawful profiling, or other unauthorized purposes.

8. Invite Links and Tokens

The Service may generate private invite links, tokens, codes, or similar identifiers used to access RSVP functionality.

You are responsible for distributing invite links or tokens only to intended recipients.

Invite links and tokens should be treated as private access credentials.

We are not responsible for access resulting from a token or invite link being shared, forwarded, published, or otherwise disclosed by you or your guests.

9. Website Visibility and Privacy Settings

The Service may allow you to control aspects of website visibility, including options such as:

  • public access;

  • guest lookup or invitation-based access;

  • search engine indexing preferences; or

  • other privacy controls.

No online access control is guaranteed to provide absolute privacy or security.

You are responsible for selecting privacy settings appropriate for the information published on your wedding site.

If you publish highly personal or sensitive information, you do so at your own discretion.

10. Publishing

Publishing your wedding site makes the current published version available through the applicable live website address or route.

You are responsible for reviewing your site before publishing.

Changes made in the builder may not appear on the live site until you publish or update the published version.

We do not guarantee that every unpublished draft will be retained indefinitely.

11. Third-Party Services

The Service may rely on third-party platforms and providers for services such as:

  • hosting;

  • databases;

  • authentication;

  • file storage;

  • payment processing;

  • marketplace sales;

  • analytics;

  • email or messaging; and

  • infrastructure.

These providers operate under their own terms and privacy policies.

We are not responsible for outages, errors, policy changes, or failures caused solely by third-party services outside our reasonable control.

12. Service Availability and Changes

We aim to keep the Service available and functioning, but we do not guarantee uninterrupted or error-free operation.

The Service may occasionally be unavailable due to:

  • maintenance;

  • software updates;

  • security issues;

  • third-party outages;

  • internet or hosting failures; or

  • circumstances outside our reasonable control.

We may modify features, designs, technical systems, or functionality where reasonably necessary to maintain or improve the Service.

13. Data Deletion

You may request deletion of your account, wedding site, or associated data by contacting us at support@occaselle.com.

Some information may be retained where reasonably necessary to:

  • comply with legal obligations;

  • resolve disputes;

  • prevent fraud or abuse;

  • maintain financial or transaction records; or

  • enforce these Terms.

Deletion requests will be handled in accordance with our Privacy Policy.

14. Prohibited Uses

You may not use the Service to:

  • violate applicable law;

  • impersonate another person;

  • gain unauthorized access to another wedding site or account;

  • distribute malware or harmful code;

  • interfere with the operation or security of the Service;

  • scrape, reverse engineer, or exploit the Service except where applicable law expressly permits;

  • resell or commercially redistribute access to the builder without permission;

  • use guest data for unrelated marketing or spam; or

  • use the Service for fraudulent, abusive, or deceptive purposes.

15. Intellectual Property

The Service, including its software, designs, code, templates, theme systems, layouts, branding, user interface, and underlying technology, is owned by or licensed to Destine LLC and is protected by applicable intellectual property laws.

Your purchase grants you a limited, personal, non-transferable right to use the Service for the wedding associated with your purchase.

You do not acquire ownership of the builder software, templates, platform code, or underlying technology.

Your own Customer Content remains yours as described in Section 6.

16. Suspension or Termination

We may suspend or terminate access to the Service if you materially violate these Terms, engage in fraud or abuse, interfere with the Service, or use the Service unlawfully.

Where reasonably practicable, we may provide notice before termination.

Termination does not create a right to a refund except where required by law or applicable marketplace policy.

17. Disclaimers

The Service is provided on an “as is” and “as available” basis to the fullest extent permitted by law.

We do not guarantee that:

  • the Service will always be uninterrupted;

  • every feature will remain available indefinitely;

  • the Service will be error-free;

  • third-party systems will always function correctly; or

  • a wedding site will achieve any particular result.

Nothing in these Terms excludes rights that cannot legally be excluded.

18. Limitation of Liability

To the fullest extent permitted by law, Destine LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the Service.

To the fullest extent permitted by law, our total liability arising out of or relating to the Service will not exceed the amount you paid for the Service giving rise to the claim.

Some jurisdictions do not allow certain liability limitations, so some of these limitations may not apply to you.

19. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Destine LLC from claims, damages, liabilities, and reasonable costs arising from:

  • Customer Content you submit;

  • your unlawful use of guest information;

  • your violation of these Terms; or

  • your infringement of another person’s rights.

20. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.

Any dispute arising from these Terms will be handled in a court of competent jurisdiction, subject to any rights that applicable law gives you to bring a claim elsewhere.

21. Changes to These Terms

We may update these Terms from time to time.

When material changes are made, we may update the effective date and provide notice where reasonably appropriate.

Your continued use of the Service after updated Terms become effective constitutes acceptance of those updated Terms to the extent permitted by law.
